Healthy Cosmos® Private Limited, a Medical Tourism Facilitation, Information technology and digital services provider duly incorporated under the provisions of the Companies Act in India (“we”, “us”, “our”), offers services to all individuals accessing or using our digital platforms and websites (www.healthy-cosmos.com, www.BookTeleMed.com) (collectively “Platforms” or “Application” or “Portal”) for any reason (“you”, “your”, “yours”, “User”) subject to the notices, terms, and conditions set forth in these terms and conditions (“Terms and Conditions”, “Agreement”), read with this Privacy Policy.

Note: All telehealth, virtual/online healthcare, medical consultation and Medical Tourism Facilitation services are provided by registered and/or licensed healthcare professionals (“healthcare professionals”, “healthcare providers”, “doctors”, “HCPs”), leading Hospitals and our affiliates using our platform. These applications are tools allowing patients to connect with healthcare professionals, schedule appointments, make secure payments, manage their personal health records, and share information with HCPs for advice.

Commitment to Privacy

Our company, Healthy Cosmos® Private Limited, is committed to protecting the privacy and security of our patients’ personal and medical information. This privacy policy outlines how our company collects, uses, protects, and discloses the personal and medical information of our clients and their patients. We take the protection of personal information seriously and are committed to complying with all relevant Indian laws and regulations. We offer these services from India and fall under Indian jurisdiction and laws.

Collection of Personal and Medical Information

Our associated healthcare providers or healthcare professionals use our digital platform(s) to collect personal and medical information from patients to provide them with telehealth, virtual medical care, and second medical opinion services. This information may include, but is not limited to, patient name, date of birth, contact information (like address, email, and telephone), medical history, and any other information necessary for providing services.

Use of Personal and Medical Information

The healthcare professionals and employees of Healthy Cosmos® Private Limited use patients’ personal and medical information for the following purposes:

  • To provide telehealth or online/virtual care services or medical consultation.
  • To communicate with patients regarding their health concerns.
  • To bill and collect payments.
  • To comply with legal and regulatory requirements.
  • For quality assurance and training purposes.

 

Disclosure of Personal and Medical Information

We may disclose patients’ personal and medical information in the following circumstances:

  • To healthcare providers, our employees, and contractors who need the information to provide telehealth services, online/virtual care services, or medical consultation.
  • To third-party providers who perform services on our behalf, such as billing and payment processing, IT, and digital platform maintenance.
  • To comply with legal and regulatory requirements.
  • Scheduling appointments.

Security Measures and Data Management

We take appropriate security measures to protect personal information against unauthorized access, alteration, disclosure, or destruction. We also have procedures in place to handle suspected data breaches. However, please note that telehealth communications or personal information may not be entirely secure, and there is a risk that information transmitted may be intercepted or accessed by unauthorized parties. Your data is stored securely on our data centers in India and can also be shared or stored across the locations where we operate or find secure data facilities.

Changes to this Privacy Policy

We may need to make changes to our privacy policy from time to time to comply with Indian laws. Please refer to the updated policy whenever you avail services and may have any privacy concerns.

Data Retention

We will retain personal information for as long as necessary to provide telehealth services and to comply with legal requirements. If a user specifically requests to delete his/her data, we respect that and follow their instructions. Once the data/information is deleted from our records, we cannot provide any access to their information or take any responsibility for the loss of their information.

Patient Rights

Patients have the right to access, correct, and delete their personal information. They also have the right to object to the processing of their personal information and to request its editing or deletion by contacting us through our website or email.

Indemnification

All clients and patients receiving services from us or our associated healthcare professionals agree to indemnify and hold harmless our company, its officers, directors, employees, partners, doctors, associated healthcare providers using our technology, agents, and vendors from any claims, damages, and expenses, including reasonable attorneys’ fees, arising out of your use of our telehealth and/or any other services offered by Healthy Cosmos™ Private Limited or its associates.

No Warranties

Our service is provided on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied, as to the operation of the service or the information, content, materials, or products included on the service.

Legal Jurisdiction

Please be aware that the laws of India and any other countries from where healthcare specialists are offering their services may differ from the laws of your country of residence. The healthcare provider providing the telehealth service is bound by the laws and regulations of India or the country from where the health specialist is providing the services. We recommend consulting with your local healthcare provider before making any decisions about your medical treatment. The telehealth service is intended to supplement or assist and provide added value, not replace, any existing relationship you have with your local healthcare providers.

Global Medical Tourism Services

In addition to our telehealth services, Healthy Cosmos® Private Limited offers global medical tourism services. This involves connecting patients and healthcare providers from various countries, including but not limited to the USA, UK, Canada, Africa, Oman, Australia, Germany, Singapore, and India. These services facilitate access to world-class medical care for patients seeking treatments abroad. When availing of our global medical tourism services, patients agree to the following additional terms:

  • The medical tourism services are provided through partnerships with accredited hospitals and healthcare providers in various countries.
  • Healthy Cosmos® Private Limited does not take responsibility for the medical outcomes of treatments received abroad. Patients are advised to thoroughly research and understand the qualifications and reputation of the healthcare providers.
  • Patients must comply with the legal and regulatory requirements of the country where they receive medical treatment.
  • Healthy Cosmos® Private Limited facilitates the coordination of appointments, travel arrangements, and other logistics but does not guarantee specific outcomes or the availability of particular treatments.

User Accounts

As a registered patient of Healthy Cosmos® Private Limited, you can access your patient user account and applicable services using the user account details provided by Healthy Cosmos® Private Limited. Patients who choose to self-register through the patient portal or patient mobile application will need to wait until their registration is confirmed by Healthy Cosmos® Private Limited before their account is active. By registering, you agree that:

  • You are not impersonating any other person and are using your actual identity.
  • Your registration is subject to verification and confirmation by Healthy Cosmos® Private Limited, and your patient user account will be activated only after confirmation.
  • The personal information provided during the registration process is true, accurate, current, and complete. You are required to periodically review and update your registration data to ensure that it is always current and correct.
  • Your username and password are unique to you, and you agree not to disclose or share your username and password with any third party. You are responsible for keeping your password confidential and for notifying us immediately if your password has been hacked or stolen.
  • You are solely responsible for any activities conducted on or through the patient portal and/or mobile application with your account, regardless of whether or not you are the individual who undertakes such activities. This includes any unauthorized access and/or use of your account or your computer. You hereby release and hold harmless Healthy Cosmos® Private Limited from any and all claims and causes of action arising out of or resulting from a third party’s unauthorized use of your account.
  • Family user accounts added under your user account should strictly be added only for minors and dependents in your family who cannot operate their own independent user account and who have consented (if able) to you doing so on their behalf. Family members who can have their own phone number and/or email address should set up and operate their own independent patient account. You will receive all notifications related to your family account members and will be able to access their accounts. Only a maximum of six family user accounts can be included under your user account. By setting up a family user account under your account for a dependent adult family member, you agree that you have done so with the necessary consent of the family member.
  • Healthy Cosmos® Private Limited reserves the right to deny or revoke access to any user account at its sole discretion.

Data Management in the HIPAA-Compliant Telehealth Portal (www.BookTeleMed.com )

The application stores data, including PHI data, communications, and usage data including but not limited to location, device type, operating system, browser, date-time, and context usage, in HIPAA-compliant cloud infrastructure on Amazon Web Services. All data storage and transmissions are encrypted.

  • The accuracy, integrity, and completeness of the personal health information you enter, directly sync from health sensor devices, and/or sync from your other health or fitness accounts into your health record is your responsibility, and Healthy Cosmos® Private Limited assumes no liability for it.
  • Any files that you upload into your personal health record in the app, including your profile picture, medical reports, and any other file attachments, are securely uploaded and stored in your personal health record in our secure cloud storage.
  • Data in your personal health records will be accessible to and modifiable by authorized healthcare providers of Healthy Cosmos® Private Limited for the purpose of providing you with healthcare services.
  • Non-personalized system analysis of non-identifiable patient data may be done to enable better healthcare outcomes for the patients of Healthy Cosmos® Private Limited. However, the identity of individual users will remain completely anonymous in such analysis.
  • All user data is covered by the Privacy Policy of Healthy Cosmos® Private Limited.
  • Data in this application of Healthy Cosmos® Private Limited can be created by your healthcare providers and by yourself (the patient) after logging into the application with your authorized user
